Important: These Terms contain provisions concerning your legal rights, including limitations of liability, warranty disclaimers, an agreement to resolve certain disputes through individual arbitration, and a waiver of class and jury proceedings. Please read carefully before accessing the Site or placing an order.

Acceptance of These Terms
These Terms of Service (“Terms”) govern your access to and use of www.megafinfishing.com, including its online store, pages, features, content, customer accounts, forms, newsletters, Guide Program, Field Journal, and related services collectively referred to as the “Site.”
These Terms also govern purchases from:

In these Terms, “MegaFin,” “we,” “us,” and “our” mean MegaFin Fishing LLC. “You” and “your” mean the person accessing the Site, submitting information, or placing an order.
You accept these Terms by affirmatively indicating your agreement — for example, by checking an acceptance box or clicking a button indicating that you agree to these Terms and our Privacy Policy at account creation, at checkout, or when subscribing to our communications — or by placing an Order. Where MegaFin presents these Terms together with a required acceptance action, completing that action manifests your assent to these Terms and the Privacy Policy.
MegaFin maintains records of the version of these Terms in effect and, where technically available, records of your acceptance, including the date and time. The version identified by the “Last Updated” date above governs your transaction, unless a different version was presented to and accepted by you at the time of the transaction.
If you do not agree, do not create an account, submit information, place an Order, or otherwise use the Site to transact.
Definitions
For purposes of these Terms:
- “Content” means text, photographs, illustrations, graphics, videos, audio, product descriptions, articles, designs, logos, software, data, and other materials appearing on or made available through the Site.
- “Customer” means a person or entity that places or attempts to place an order.
- “Guide Program” means any guide, ambassador, professional angler, outfitter, lodge, or related partnership program administered by MegaFin.
- “Order” means a request submitted through the Site to purchase one or more Products.
- “Products” means fishing flies, fly assortments, fly boxes, apparel, accessories, gift cards, and other goods offered by MegaFin.
- “Product Page” means the Site page describing a particular Product.
- “User Content” means photographs, videos, reviews, testimonials, messages, comments, or other content submitted to MegaFin by a user, customer, guide, collaborator, or other third party.
- “Writing” includes electronic communications where permitted by applicable law.
Headings are provided for convenience and do not limit the meaning of these Terms.
Eligibility and Age Requirements
You may browse the Site regardless of age. You may place an Order only if:
- You are at least 18 years old;
- You are legally capable of entering a binding contract; or
- You are acting with the knowledge, consent, and involvement of a parent or legal guardian who agrees to these Terms.
MegaFin does not presently operate a formal age-verification system. Products containing fishing hooks are not toys and must be kept away from children and pets. If you are a parent or legal guardian and believe a minor placed an unauthorized Order, contact us promptly at fish@megafinfishing.com.
Electronic Communications and Electronic Contracting
By using the Site, providing an email address, creating an account, or placing an Order, you consent to receive communications electronically where permitted by law. Electronic communications may include:
- Order confirmations;
- Payment confirmations;
- Shipping notices;
- Customer-service messages;
- Legal disclosures;
- Updates to these Terms;
- Privacy notices;
- Account communications; and
- Marketing messages where you have subscribed or otherwise consented.
You agree that electronic notices, agreements, disclosures, and records satisfy any legal requirement that such communication be in writing, except where applicable law requires another format. You may retain a copy of these Terms electronically or print them for your records.
Privacy Policy
Our collection, use, disclosure, retention, and protection of personal information are governed by the MegaFin Privacy Policy. The Privacy Policy is incorporated into these Terms by reference, but it does not create contractual rights beyond those required by applicable law unless it expressly states otherwise.
Site Access and Customer Accounts
You may be permitted to purchase as a guest or create a customer account. If you create an account, you agree to:
- Provide accurate, complete, and current information;
- Maintain the confidentiality of your login credentials;
- Restrict unauthorized access to your account and devices;
- Notify us promptly of suspected unauthorized activity; and
- Accept responsibility for activity conducted through your account to the extent permitted by law.
You may not impersonate another person, use another person’s account without authorization, or create an account using false or misleading information. MegaFin may suspend or restrict an account when reasonably necessary to investigate fraud, abuse, unauthorized access, or violations of these Terms.
Product Descriptions
We seek to describe Products accurately and in good faith. Product Pages may include product name, intended species or fishing application, hook size, quantity, materials, dimensions, color, pattern, assortment contents, product photography, and other relevant specifications.
Descriptions concerning species, destinations, techniques, water types, presentations, or fishing conditions are general recommendations, not guarantees. The Product Page in effect when you place an Order forms part of your purchase terms, subject to these Terms.
Handmade Product Variations
MegaFin fishing flies are tied by hand. Small variations are an inherent and expected characteristic of handmade craftsmanship. Products of the same general pattern may show minor differences in proportion, fiber placement, wrap tension, thread finish, color tone, material texture, profile, head shape, flash distribution, paint or coating, and other nonmaterial details.
Material Availability and Substitutions
Fly-tying materials may vary between production batches or become temporarily unavailable. MegaFin may substitute a reasonably comparable material when the substitution has a similar color, profile, quality, and function; does not materially alter the advertised Product; does not materially reduce the Product’s quality; does not change the advertised quantity; and does not create an inaccurate species, size, or pattern representation.
Where a particular material is an essential or expressly advertised feature of a Product, MegaFin will not knowingly substitute it with a materially different material without appropriate notice.
Fly Assortments and Curated Kits
MegaFin assortments and species- or destination-focused kits are curated to include the number and general categories of flies stated on the applicable Product Page. Unless a Product Page provides an exact fixed contents list, the particular mix of patterns, colors, hook sizes, weights, profiles, and individual flies may vary according to availability, season, intended application, and MegaFin’s professional selection. The total quantity and general character of the assortment will remain consistent with the applicable Product description.
Materials
MegaFin Products are manufactured primarily using artificial or synthetic materials, including synthetic fibers, thread, flash materials, metal hooks, wire, beads, resins, adhesives, and coatings. Certain Products may contain limited natural materials obtained through commercial fly-tying suppliers, such as domesticated rooster or hen feathers, rabbit fur, or commercially sourced bucktail.
MegaFin does not knowingly use materials sourced from endangered or protected wildlife in violation of applicable law. Material composition may vary by Product and production batch. Customers with allergies, sensitivities, religious restrictions, import concerns, or other material-specific requirements should contact MegaFin before purchasing.
Product Photography and Display Variations
Product photographs are intended to reasonably represent the Products offered. The appearance of a Product may vary slightly because of handmade production, lighting, photography, screen calibration, device display, image compression, production batch, and material availability. Such differences do not constitute a defect unless the Product is materially inconsistent with the applicable description. Editorial, lifestyle, hero, or Field Journal imagery may be illustrative and may not depict the exact Product delivered.
Artificial Intelligence and Illustrative Media
The Site may contain original photography, licensed photography, stock content, composite imagery, illustrations, and content created or enhanced with artificial-intelligence-assisted tools. MegaFin does not intend to use AI-generated or materially altered imagery to misrepresent the actual appearance of a Product, the quantity included, product materials, construction, size, or material features relevant to the purchasing decision.
AI-assisted or generated imagery may be used for editorial, storytelling, atmospheric, conceptual, or illustrative purposes. A Product Page should be evaluated using its written specifications and actual Product images, where provided.
Product Availability
All Products are subject to availability. MegaFin may limit available quantities, discontinue a Product, modify a Product, correct inventory records, decline bulk purchases, restrict resale orders, or cancel an Order when inventory is unavailable. Adding a Product to a shopping cart does not reserve inventory.
Pricing and Currency
Prices are displayed in U.S. dollars unless expressly stated otherwise. Prices may change without notice, but a price change will not apply retroactively to an Order already accepted, except in the case of an obvious error, fraud, or legally required adjustment. Currency conversions displayed by a browser, card issuer, payment provider, or third-party service are estimates and are not controlled by MegaFin. Your financial institution may impose foreign-transaction, currency-conversion, or other fees.
Pricing, Listing, and Technical Errors
MegaFin attempts to maintain accurate pricing, descriptions, inventory, promotions, and shipping information. Errors may nevertheless occur. If an Order is affected by an obvious pricing, description, inventory, technical, tax, shipping, or promotional error, MegaFin may contact you for instructions, correct the error, cancel the affected item or Order, and refund amounts charged for cancelled items. MegaFin will not knowingly exploit a pricing error against a Customer.
Taxes
Applicable sales, use, or similar taxes may be calculated and charged at checkout based on shipping destination, product type, customer information, applicable tax law, and the capabilities of the commerce platform. Customers are responsible for taxes not collected by MegaFin when applicable law places that responsibility on the purchaser. International duties, import taxes, and customs charges are addressed in Sections 31 and 32.
Payment Methods and Authorization
Available payment methods may include credit cards, debit cards, PayPal, Apple Pay, Google Pay, and other methods displayed at checkout. By submitting payment information, you represent that the information is accurate, you are authorized to use the payment method, the transaction does not violate applicable law, and MegaFin and its payment providers may charge the total amount shown at checkout.
Payment transactions are processed by third-party payment providers. Their separate terms and privacy notices may apply. MegaFin does not directly store complete card numbers or card security codes on servers controlled solely by MegaFin.
Order Submission and Acceptance
Submitting an Order constitutes an offer to purchase. An automated Order confirmation acknowledges receipt but does not necessarily constitute final acceptance. MegaFin may accept an Order by sending confirmation that the Order has been accepted, beginning fulfillment, dispatching the Products, or taking another clear action indicating acceptance.
MegaFin may reject, limit, or cancel an Order for legitimate reasons, including product unavailability, pricing or listing errors, suspected fraud, payment failure, sanctions or export restrictions, shipping restrictions, incorrect customer information, suspected unauthorized resale, abuse of promotions, or violation of these Terms. If MegaFin cancels an Order after capturing payment, MegaFin will refund the amount charged for the cancelled Products.
Fraud Prevention
MegaFin and its service providers may use automated and manual fraud-prevention measures. We may request reasonable verification before processing an Order, including confirmation of billing information, shipping information, identity, payment authorization, or the commercial purpose of an unusually large Order. We may cancel or hold an Order when reasonably necessary to prevent fraud, unauthorized transactions, abuse, or unlawful activity. We will not request full payment credentials through ordinary email.
Purchase Limits and Unauthorized Resale
MegaFin may limit purchase quantities per person, household, account, payment method, address, or Order. Unless MegaFin provides written authorization, Products purchased through the consumer Site are intended for personal use or legitimate use by guides and anglers and may not be acquired through bots, fraudulent accounts, or promotional abuse for unauthorized resale. This section does not prohibit lawful resale rights that cannot be restricted under applicable law. Wholesale or dealer inquiries should be submitted directly to MegaFin.
Promotions and Discount Codes
Promotions, coupons, giveaways, gifts with purchase, and limited offers may be governed by additional terms presented with the offer. Unless otherwise stated:
- Offers are available only during the advertised period;
- Offers are subject to actual availability;
- Discount codes may not be combined;
- Discount codes have no cash value;
- Discounts do not apply retroactively;
- Promotional items cannot be exchanged for cash;
- A gift with purchase is available only while the disclosed inventory lasts;
- Returns may reduce or eliminate eligibility for a promotional gift; and
- Fraudulent, duplicated, transferred, resold, or unauthorized codes may be cancelled.
MegaFin may correct, suspend, or terminate a promotion because of error, fraud, abuse, legal requirement, or circumstances beyond reasonable control. MegaFin will not use false scarcity, fictitious countdowns, or materially misleading urgency claims.
Gift Cards
MegaFin gift cards, when offered, may be used only through authorized MegaFin sales channels; are not redeemable for cash except where required by law; may not be used to purchase another gift card unless permitted; are not credit or debit cards; should be protected like cash; and may be subject to additional terms disclosed at purchase.
MegaFin is not responsible for unauthorized use of a gift card after delivery when the code was disclosed because of the purchaser’s or recipient’s acts or failure to protect it. Unless otherwise required or permitted by applicable law and clearly disclosed before purchase, MegaFin gift cards do not expire and are not subject to dormancy, inactivity, or service fees. Any expiration date or fee that MegaFin may lawfully apply will comply with the federal Credit CARD Act and applicable state law and will be disclosed before purchase.
Shipping Destinations
MegaFin may ship within the United States and to selected international destinations. Available destinations and carriers may change based on carrier coverage, customs restrictions, sanctions, product restrictions, cost, risk, service availability, and operational considerations. The availability of a destination at checkout does not guarantee that every Product may lawfully or operationally be shipped there.
Processing and Dispatch Times
Processing and dispatch estimates are provided in good faith. Handmade, limited-production, customized, pre-order, back-order, or high-demand Products may require additional processing time. Any estimated dispatch date is not a guarantee unless MegaFin expressly states in writing that it is guaranteed.
MegaFin will seek to ship Products within the time stated on the Product Page or checkout. If no shipping time is stated, MegaFin will process the Order within the period required by applicable law. MegaFin’s shipping practices are intended to comply with the FTC Mail, Internet, or Telephone Order Merchandise Rule (16 CFR Part 435). If MegaFin cannot ship within the promised or legally applicable period, MegaFin will provide any notice, consent opportunity, cancellation option, or refund required by applicable law.
Delivery Estimates
Carrier delivery dates are estimates unless the carrier expressly provides a guaranteed service. MegaFin is not responsible for delays caused by carrier operations, weather, natural disasters, customs, government action, labor disputes, incorrect addresses, security inspections, remote-area service limitations, public emergencies, or other circumstances outside MegaFin’s reasonable control.
MegaFin does not guarantee arrival before a fishing trip, tournament, holiday, birthday, expedition, flight, event, or other specific date unless MegaFin expressly accepts that obligation in writing. Customers should order sufficiently in advance.
Shipping Address
You are responsible for providing a complete and accurate shipping address. Review the address carefully before completing checkout. Contact MegaFin promptly if an address correction is needed; MegaFin cannot guarantee that an address can be changed after fulfillment begins. Additional charges resulting from an incorrect, incomplete, refused, or undeliverable address may be charged to the Customer to the extent permitted by law.
Tracking and Delivery Confirmation
Where available, MegaFin or the carrier may provide tracking information. A carrier’s delivery scan is evidence that the package was delivered to the stated location, but it does not eliminate any rights that cannot legally be waived. Customers should promptly report suspected theft, misdelivery, damage, or loss and cooperate with reasonable carrier or insurance investigations. MegaFin may require photographs, packaging, affidavits, police reports, or other reasonable documentation depending on the circumstances and claim value.
Risk of Loss and Title
To the extent permitted by applicable law, title and risk of loss pass as provided by the applicable shipping contract and governing law. Notwithstanding any risk-of-loss provision, MegaFin may voluntarily assist with legitimate carrier claims involving loss or transit damage. Nothing in this section eliminates nonwaivable consumer rights.
International Orders
By placing an Order for delivery outside the United States, you acknowledge that delivery may take longer than domestic delivery; customs may inspect the shipment; local authorities may delay, return, seize, or destroy a shipment; product classifications may differ by country; fishing tackle or animal-origin materials may be regulated differently; the recipient may need to provide information to the carrier or customs authority; and MegaFin cannot guarantee customs clearance. You are responsible for reviewing the import rules applicable to your destination.
Customs Duties, Import Taxes, and Fees
Unless expressly stated otherwise, prices and shipping charges do not include customs duties, import taxes, tariffs, brokerage fees, handling fees, storage charges, inspection charges, or other destination-country assessments. The recipient is responsible for those amounts. MegaFin does not control customs charges and cannot predict the amount. A refusal to pay import charges does not automatically entitle the Customer to a full refund.
Refused, Returned, or Seized International Shipments
If an international shipment is refused, unclaimed, returned, seized, or destroyed because of unpaid duties or taxes, import restrictions, recipient failure to cooperate, incorrect information, abandonment, prohibited destination, customs action, or other circumstances outside MegaFin’s control, MegaFin may deduct from any available refund: original shipping charges, return shipping, duties or fees charged to MegaFin, carrier charges, brokerage fees, and the value of Products not returned in resalable condition. No refund is required for Products lawfully seized, destroyed, abandoned, or not returned to MegaFin, except where applicable law requires otherwise or the problem resulted from MegaFin’s error.
Export Controls and Economic Sanctions
MegaFin is a United States company and must comply with applicable U.S. export-control and economic-sanctions laws. You may not purchase, receive, transfer, export, re-export, or use Products in violation of applicable law. MegaFin may refuse, suspend, cancel, or investigate a transaction involving a restricted or sanctioned country, territory, person, or entity; a prohibited end use; a person appearing on an applicable restricted-party list; suspected sanctions evasion; misleading destination or identity information; or a transaction requiring authorization MegaFin does not possess. You represent that you are not placing an Order on behalf of a prohibited person or for an unlawful destination or purpose.
Returns
Unless a Product Page or promotion states otherwise, unopened and unused physical Products in their original condition may be eligible for return within 30 days after documented delivery. To request a return, contact fish@megafinfishing.com and include customer name, order number, product to be returned, reason for return, and supporting photographs where relevant. MegaFin may provide return instructions or a return authorization. Sending a Product back without contacting MegaFin does not guarantee that the return will be accepted or correctly identified.
Return Conditions
Returned Products must, as applicable, be unused, unopened, in original condition, include original packaging, include all components, and be packaged adequately for return shipping. MegaFin may deny or reduce a refund where a Product has been used, is damaged after delivery, is incomplete, is contaminated, is materially altered, is returned outside the permitted period, or cannot reasonably be resold for reasons caused by the Customer. Any deduction will be proportionate and consistent with applicable law.
Non-Returnable Products
The following are generally not eligible for ordinary return:
- Used fishing flies;
- Opened assortments;
- Products damaged after delivery;
- Personalized or customized Products;
- Final-sale Products clearly identified before purchase;
- Gift cards;
- Downloadable or digital Products after access or delivery;
- Promotional gifts not independently purchased; and
- Products subject to hygiene, safety, or legal restrictions.
This exclusion does not apply where the Product was damaged, defective, materially misdescribed, incorrectly shipped, or otherwise subject to a nonwaivable legal right.
Damaged, Defective, or Incorrect Orders
Inspect your Order promptly after delivery. If a Product arrives damaged, contains a manufacturing defect beyond normal handmade variation, or differs materially from the Product ordered, contact MegaFin as soon as reasonably possible. Include order number, description of the problem, photographs of the Product, photographs of the packaging where applicable, and any other information reasonably necessary to evaluate the issue. Depending on the circumstances and applicable law, MegaFin may provide replacement, repair where appropriate, exchange, refund, store credit, or another agreed resolution. MegaFin may request return of the affected Product and may provide or reimburse reasonable return shipping when the problem resulted from MegaFin’s error.
Return Shipping
Unless a return results from MegaFin’s error or applicable law requires otherwise, the Customer is responsible for return postage, adequate packaging, tracking, insurance where appropriate, and risk of loss during return shipment. MegaFin is not responsible for a return package that is lost, damaged, or delivered to an incorrect address because of the Customer’s shipping arrangements.
Refunds
Approved refunds will generally be issued to the original payment method. MegaFin may not be able to refund a transaction through a different payment method. Processing time after MegaFin initiates a refund depends on the payment provider and financial institution. Shipping charges are not refundable unless the return resulted from MegaFin’s error, the applicable offer expressly provides otherwise, or applicable law requires a refund. MegaFin may issue store credit only with the Customer’s agreement unless store credit is the expressly disclosed remedy for a promotion or non-cash item.
Exchanges
Exchanges are subject to availability. MegaFin may process an exchange as a return of the original Product and a separate replacement Order. Price differences, taxes, and shipping charges may apply. A requested replacement is not reserved until MegaFin confirms availability.
Chargebacks and Payment Disputes
Nothing in these Terms limits a lawful right to dispute a charge with a card issuer or payment provider. Before initiating a chargeback, you are encouraged to contact MegaFin so we can attempt to resolve the issue. MegaFin may respond to a chargeback by providing order records, acceptance records, tracking information, delivery confirmation, customer communications, product descriptions, and other relevant evidence. MegaFin may suspend future Orders associated with fraudulent, abusive, or repeated unsupported chargebacks. MegaFin will not penalize a Customer merely for exercising a lawful payment-dispute right in good faith.
Product Safety
Fishing flies contain sharp hooks and may contain small components. Improper handling can cause puncture wounds, cuts, eye injuries, infection, choking, injury to children, injury to animals, and damage to clothing or property. You are responsible for handling, storing, transporting, casting, rigging, and disposing of Products safely. Recommended precautions include:
- Keeping hooks away from children and pets;
- Using appropriate eye protection;
- Inspecting hooks and materials before use;
- Securing flies during transport;
- Removing damaged or corroded hooks from service;
- Using appropriate tools when removing hooks;
- Following airline and transportation rules;
- Avoiding unsafe casting near other persons; and
- Seeking appropriate medical attention after a serious puncture or embedded hook injury.
Corrosion, Maintenance, and Product Life
Saltwater, moisture, chemicals, improper storage, repeated use, and fish contact may cause corrosion, discoloration, weakening, material loss, or deterioration. Product life depends on use, species, water conditions, hook contact, storage, cleaning, drying, rinsing, environmental exposure, and maintenance. After saltwater use, customers should rinse appropriate Products with fresh water, allow them to dry completely, and store them safely. Normal wear, corrosion, and damage caused by use are not manufacturing defects.
No Guarantee of Fishing Results
MegaFin does not guarantee that a fish will strike a Product, that a particular species will be caught, a specific catch rate, fishing success, guide success, tournament performance, Product performance under every condition, or results shown in editorial content, testimonials, photographs, or videos. Fishing outcomes depend on factors outside MegaFin’s control, including angler skill, presentation, equipment, leader and line selection, weather, water conditions, fish behavior, location, season, regulations, and chance.
Informational Content
Content in the Field Journal, Product descriptions, videos, newsletters, social media, or Guide Program is provided for general informational, editorial, educational, or entertainment purposes. It is not a substitute for a licensed local fishing guide, navigational information, marine forecasts, weather warnings, emergency information, medical advice, legal advice, conservation authority instructions, or official fishing regulations. You are responsible for making independent safety and legal decisions.
Assumption of Outdoor and Fishing Risks
Fishing, boating, wading, casting, hook handling, wildlife encounters, remote travel, and outdoor recreation involve inherent risks. These may include drowning, falls, cuts, hook injuries, weather exposure, lightning, currents, tides, dangerous wildlife, boat accidents, equipment failure, illness, remote-location hazards, travel disruption, and serious bodily injury or death. You voluntarily assume the ordinary and inherent risks of fishing and outdoor activity. Nothing in these Terms releases MegaFin from liability that cannot lawfully be released, including liability arising from fraud, willful misconduct, gross negligence where nonwaivable, or a legally actionable Product defect.
Compliance with Fishing and Conservation Laws
You are responsible for complying with applicable fishing licenses, seasons, bag limits, size limits, protected-species rules, gear restrictions, catch-and-release requirements, marine-protected-area rules, access restrictions, boating requirements, import or transport laws, and conservation regulations. A reference to a species or destination does not mean that fishing for that species is legal at all times or in all places. MegaFin encourages responsible fishing, proper fish handling, lawful catch-and-release practices, and respect for aquatic ecosystems.
Product Recalls and Safety Notices
MegaFin may issue a product-safety notice, correction, withdrawal, or recall where reasonably necessary. You agree to review safety communications sent to the contact information associated with your Order. MegaFin may request that affected Products be returned, destroyed, or removed from use. Remedies will be determined according to the circumstances and applicable law.
Prohibited Uses of the Site
You may not:
- Use the Site for an unlawful purpose;
- Violate another person’s rights;
- Submit false or misleading information;
- Attempt unauthorized access;
- Circumvent security measures;
- Introduce malware;
- Interfere with Site operation;
- Use bots to manipulate purchasing or promotions;
- Scrape or harvest personal information;
- Conduct fraudulent transactions;
- Impersonate another person;
- Abuse customer-service personnel;
- Submit false reviews;
- Misuse the Guide Program;
- Resell discount codes;
- Frame or mirror the Site without permission; or
- Use Site Content commercially without authorization.
Automated Access, Scraping, and Data Mining
Except for ordinary indexing by generally recognized public search engines in accordance with MegaFin’s technical instructions, you may not use automated systems to scrape the Site, extract product information, monitor prices at scale, copy images or descriptions, build a competing database, harvest contact information, circumvent rate limits, reproduce the Site, train commercial recommendation systems, or create derivative commercial datasets. This restriction does not prohibit activity that cannot lawfully be restricted, including rights granted by mandatory law.
Artificial-Intelligence Training Restrictions
Without MegaFin’s prior written permission, you may not use MegaFin Content to train or fine-tune an artificial-intelligence model; create a machine-learning dataset; generate embeddings for a commercial content database; develop synthetic replicas of MegaFin Products, branding, photography, or copy; produce substantially similar commercial marketing assets; train an image generator on MegaFin photography; train a text generator on the Field Journal or Product descriptions; or facilitate automated imitation of MegaFin’s brand identity. This section does not prohibit ordinary personal use, lawful quotation, noninfringing research, or use authorized by applicable law.
Reviews and User Content
If MegaFin permits reviews or other User Content, you agree that your submission will be truthful, reflect your genuine experience, not contain unlawful or infringing material, not impersonate another person, not contain malicious code, not be defamatory, not include deceptive endorsements, and disclose any material connection with MegaFin where required. MegaFin may moderate, refuse, or remove User Content for legitimate legal, operational, or policy reasons.
License to User Content
By submitting User Content directly to MegaFin for publication or marketing, you grant MegaFin a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, publish, distribute, format, crop, resize, caption, translate, and make reasonable technical adaptations to the User Content for operating, promoting, and improving MegaFin, subject to the permissions communicated when the content is submitted. This license does not transfer your ownership. You represent that you have the authority to grant the applicable license.
Endorsements, Guides, and Material Connections
Guides, ambassadors, collaborators, reviewers, or content creators may receive free Products, discounts, affiliate compensation, commissions, sponsorship, promotional exposure, or other benefits. Where a material connection exists, that connection must be disclosed clearly and conspicuously in the relevant content, in the manner required by the FTC’s Endorsement Guides (16 CFR Part 255) and 16 CFR Part 465. MegaFin will not condition any benefit on an endorsement expressing a particular sentiment.
Participation in the Guide Program does not make a participant an employee, legal partner, agent, or representative of MegaFin unless a written agreement expressly states otherwise.
MegaFin Intellectual Property
The Site and its original Content are owned by MegaFin or used under license. Protected materials may include MegaFin’s name, logos, product branding, packaging, site design, original photography, product descriptions, illustrations, videos, Field Journal content, graphics, marketing copy, assortment presentation, original pattern variations, product names, and the selection and arrangement of Site Content. These materials may be protected by copyright, trademark, trade-dress, unfair-competition, or other laws. No right is granted except as expressly stated in these Terms.
Product Names and Fly-Tying Traditions
Fly fishing includes established patterns, functional techniques, and commonly used names that may belong to the broader fishing tradition, may be descriptive, or may be associated with third-party creators. MegaFin does not claim exclusive ownership over public-domain methods, functional tying techniques, or third-party rights. MegaFin does claim rights, where legally available, in its original photographs, original written descriptions, original graphics, packaging, logos, distinctive branding, original product names, original pattern modifications, and other protectable expressions or source identifiers. Reference to a third-party pattern, species, destination, or technique does not imply endorsement or ownership.
Limited Site License
Subject to these Terms, MegaFin grants you a limited, revocable, non-exclusive, non-transferable license to access the Site for personal, noncommercial browsing and lawful purchasing. This license does not include a right to copy the Site, resell Site access, reproduce Content commercially, use trademarks, remove rights notices, create derivative commercial works, scrape Content, frame the Site, or use Content for unauthorized AI training. MegaFin may revoke this license when you violate these Terms.
Copyright Complaints
If you believe that Content on the Site infringes your copyright, send a written notice to fish@megafinfishing.com with the subject line “Copyright Notice.” The notice should include: identification of the copyrighted work; identification and location of the allegedly infringing material; your contact information; a statement of good-faith belief that the use is unauthorized; a statement that the information is accurate and that you are authorized to act; your physical or electronic signature; and any other information required by applicable law. MegaFin may remove or restrict access to disputed material while evaluating the notice. Submitting a knowingly false infringement notice may create legal liability.
DMCA Designated Agent
If MegaFin operates a service that stores User Content at a user’s direction and seeks protection under the safe-harbor provisions of the Digital Millennium Copyright Act, MegaFin may designate and register an agent with the U.S. Copyright Office.
Third-Party Websites and Services
The Site may link to social media, videos, guides, lodges, payment services, shipping services, maps, advertising platforms, and other external services. MegaFin does not control and is not responsible for the independent content, security, availability, terms, privacy practices, or products of third-party services. A link does not necessarily indicate endorsement.
No Written Product Warranty Unless Expressly Offered
Except where MegaFin expressly provides a separate written warranty for a specific Product, MegaFin does not offer an additional written product warranty beyond the Product description, the return and damaged-order provisions in these Terms, any express representation made on the Product Page, and rights that cannot be waived under applicable law. Customer-service statements should not be interpreted as creating a lifetime, satisfaction, performance, or other warranty unless MegaFin expressly states the warranty terms in writing.
Disclaimer of Warranties
Limitation of Liability
Release of Inherent-Risk Claims
To the fullest extent permitted by law, you release MegaFin from claims arising solely from the ordinary and inherent risks of fishing and outdoor recreation described in these Terms. This release does not apply to fraud, willful misconduct, liability that cannot legally be released, a legally actionable manufacturing defect, or other nonwaivable consumer rights.
Indemnification
To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless MegaFin and its members, managers, employees, and contractors from third-party claims, damages, liabilities, judgments, and reasonable legal expenses arising from your unlawful use of the Site, your violation of these Terms, your User Content, your infringement of another person’s rights, your fraudulent conduct, your unauthorized resale conduct, or your violation of fishing, export, sanctions, or other applicable law. This indemnification does not require a consumer to indemnify MegaFin for MegaFin’s own negligence, wrongful conduct, or legally nonwaivable liability. MegaFin may control the defense of a covered claim, and you agree to provide reasonable cooperation.
Force Majeure
MegaFin is not responsible for delay or failure caused by circumstances beyond its reasonable control, including natural disasters, hurricanes, floods, fires, severe weather, epidemics, public emergencies, war, terrorism, civil unrest, government action, sanctions, import or export restrictions, customs delays, carrier disruption, port closure, power failure, internet outage, cyberattack, labor dispute, supply shortage, material shortage, or failure of a critical service provider. This provision does not excuse payment refunds or other remedies that applicable law requires.
Governing Law
These Terms and disputes arising from them are governed by the laws of the State of Florida, without regard to conflict-of-law rules, except where federal law applies or mandatory consumer law requires otherwise. The United Nations Convention on Contracts for the International Sale of Goods does not apply to purchases governed by these Terms, to the extent its exclusion is legally effective.
Informal Dispute Resolution
Before initiating arbitration or litigation, the complaining party must send the other party a written Notice of Dispute. A notice to MegaFin must be sent to:

Subject: Notice of Dispute
The notice must include name and contact information, order number if applicable, description of the dispute, supporting facts, amount or remedy requested, and a personally signed statement that the information is accurate. The parties will attempt in good faith to resolve the dispute for at least 30 days after receipt of a complete notice. Any applicable limitations period will be tolled during that 30-day period to the extent permitted by law.
Agreement to Individual Arbitration
Except for matters excluded below, you and MegaFin agree that disputes arising out of or relating to these Terms, the Site, an Order, a Product, Advertising, Communications, Privacy practices, a transaction, or the relationship between you and MegaFin will be resolved by binding individual arbitration rather than in court. This agreement is governed by the Federal Arbitration Act. The arbitrator, and not a court, will generally decide issues concerning the interpretation, applicability, enforceability, or formation of this arbitration agreement, except that a court will decide disputes concerning the enforceability of the class-action waiver.
Arbitration Administrator and Rules
Arbitration will be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules in effect when the arbitration is filed, as modified by these Terms. MegaFin will take the steps required for the AAA to administer consumer arbitrations under its arbitration agreement, including registering the applicable arbitration clause on the AAA Consumer Clause Registry and maintaining that registration as required by the AAA Consumer Arbitration Rules.
If the AAA is unavailable or unwilling to administer the dispute, the parties will attempt to agree on another nationally recognized consumer-arbitration provider. If they cannot agree, a court of competent jurisdiction may appoint an administrator or arbitrator. MegaFin will comply with fee-allocation requirements imposed by the applicable consumer-arbitration rules and applicable law, and will not require a consumer to pay arbitration costs that would make the process prohibitively expensive compared with court.
Arbitration Location and Format
Arbitration may be conducted by videoconference, by telephone, on written submissions, in the county where you reside, or in Pinellas County, Florida, as permitted by the applicable rules and selected by the consumer where those rules provide that choice. The arbitrator may award the same individual relief that a court could award, including statutory damages, attorneys’ fees, or injunctive relief where authorized by law. The award may be entered in any court having jurisdiction.
Excluded Claims
The arbitration agreement does not prevent either party from bringing an eligible individual claim in small claims court; seeking temporary or preliminary relief to prevent immediate intellectual-property misuse, unauthorized system access, or serious security harm; reporting a matter to a governmental agency; participating in a governmental investigation; or exercising a right that applicable law does not permit the parties to arbitrate. A claim brought in small claims court must remain individual and within that court’s jurisdiction.
Jury-Trial Waiver
Class-Action Waiver; Mass Arbitration and Batching
If 25 or more similar arbitration demands are filed against MegaFin by or with the assistance or coordination of the same law firm or coordinated group of firms within a 90-day period, those demands will be treated as “Coordinated Filings” and, to the extent the applicable arbitration rules permit, will be administered under the AAA Mass Arbitration Supplementary Rules, including any applicable process-arbitrator, global filing-fee, and mediation provisions.
Where permitted by the applicable rules, the parties will use a bellwether process: counsel will select a limited number of individual Coordinated Filings to be arbitrated first; the remaining demands will be stayed during the bellwether arbitrations; and, following the bellwether awards, the parties will participate in a single global mediation before any additional demands proceed. Any applicable statute of limitations will be tolled for stayed demands during this process to the extent permitted by law.
Arbitration Opt-Out
You may opt out of Sections 69 through 74 by sending a written notice within 30 days after the first date on which you affirmatively accept these Terms. The notice must include your full name, email address used for the Order, order number if available, mailing address, a clear statement that you opt out of arbitration, and your signature. Opting out of arbitration will not affect the remaining Terms or your ability to purchase Products.
Severability of Arbitration Provisions
If a portion of the arbitration agreement is found unenforceable, it will be limited or severed to the minimum extent necessary. If the class-action waiver is found unenforceable as to a particular claim or remedy, that claim or remedy will proceed in court after completion of arbitration of any arbitrable individual claims, unless applicable law requires otherwise. If a court determines that the entire arbitration agreement is unenforceable, Section 77 will govern the dispute.
Court Venue
For disputes not subject to arbitration or properly proceeding in court, the parties agree to the exclusive jurisdiction of the state or federal courts located in Pinellas County, Florida, except where mandatory consumer law permits the Customer to bring a claim elsewhere. Each party consents to personal jurisdiction in those courts to the extent legally effective.
Time Limit for Claims
To the extent permitted by applicable law, a claim arising from these Terms, the Site, or a Product must be commenced within one year after the claimant knew or reasonably should have known of the facts giving rise to the claim. This contractual period does not apply where applicable law prohibits shortening the limitations period, a longer period is legally required, the claim concerns fraud that could not reasonably have been discovered, the claim involves personal injury subject to a nonwaivable limitations period, or the parties agree otherwise in writing.
Suspension and Termination
MegaFin may suspend or terminate access to the Site or an account where reasonably necessary because of violation of these Terms, fraud, security risk, abuse, unauthorized access, legal obligation, threats to other users, harassment, or interference with Site operation. Termination does not eliminate obligations or rights that accrued before termination.
Changes to the Site and Products
MegaFin may modify, suspend, or discontinue Site features or Products. MegaFin is not obligated to continue offering a particular product, pattern, size, color, assortment, account feature, Guide Program benefit, shipping destination, or site function. Changes will not alter an accepted Order without appropriate notice or consent where required.
Changes to These Terms
MegaFin may update these Terms prospectively. The “Last Updated” date identifies the most recent revision. Material changes may be communicated through a Site notice, checkout notice, account notice, email, or another reasonable method. Changes will not ordinarily apply retroactively to a completed Order. Your continued use of the Site after revised Terms become effective constitutes acceptance only to the extent permitted by applicable law and the method of notice and assent is legally sufficient. Material changes to arbitration provisions will not apply retroactively to disputes of which MegaFin had actual notice before the change.
Assignment
You may not assign these Terms without MegaFin’s prior written consent. MegaFin may assign these Terms in connection with a merger, reorganization, sale of assets, change in ownership, financing, corporate restructuring, or transfer to an affiliate or successor. An assignment will not eliminate legally protected consumer rights.
No Agency or Partnership
These Terms do not create an employment relationship, partnership, joint venture, franchise, fiduciary relationship, agency, or authority to bind another party. Guide Program relationships may be governed by separate written agreements.
Third-Party Beneficiaries
Except where these Terms expressly protect MegaFin’s members, employees, contractors, or service providers, these Terms do not create rights for third-party beneficiaries.
Waiver
Failure to enforce a provision does not waive the right to enforce it later. A waiver is effective only if made in writing by a person authorized to bind MegaFin.
Severability
Except as provided specifically for arbitration, if a provision is found invalid or unenforceable, it will be limited or removed to the minimum extent necessary. The remaining provisions will continue in effect.
Entire Agreement
These Terms, together with the Privacy Policy, the Product Page, checkout disclosures, promotion-specific terms, gift-card terms, Guide Program agreements, and any other agreement expressly incorporated by reference, constitute the agreement between you and MegaFin concerning the relevant subject matter. If a specific written agreement conflicts with these Terms, the more specific agreement controls for its subject matter.
Interpretation
The words “including” and “includes” mean “including without limitation.” A reference to a law includes amendments and successor provisions. No presumption against the drafter will apply to the extent permitted by law. These Terms are written in English. If MegaFin provides a translation, the English version controls to the extent permitted by law in the event of a conflict.
Survival
Provisions that by their nature should survive termination will survive, including provisions concerning payment, intellectual property, User Content licenses, warranty disclaimers, liability limitations, indemnification, dispute resolution, governing law, export compliance, and interpretation.
